Welcome to levfy.com! These Terms of Use ( “Terms” ) govern your access to and use of The Levfy e-shop ( “Website” ), operated by Susfarm Sdn Bhd (Company Registration No. 202301035171 (1529094-U)) ( “Susfarm”, “we”, “us”, or “our” ).

By accessing or using our Website and services, you ( “User” or “Customer” ) agree to be bound by these Terms, our Privacy Policy, and all other policies referenced herein. If you do not agree with any part of these Terms, you must not use our Website or services.

Definitions

  • “Website” refers to levfy.com.
  • “Susfarm”, “we”, “us”, “our” refers to Susfarm Sdn Bhd (Company Registration No. 202301035171 (1529094-U)), the company operating The Levfy e-shop and farm.
  • “Levfy” refers to our brand of fresh produce sold on the Website.
  • “User” or “Customer” refers to any individual accessing or using the Website, including those who make purchases.
  • “Products” refer to the fresh greens, salad packs, and other items available for purchase on the Website under the Levfy brand.

User Accounts

  • You may create an account on our Website to facilitate your purchases and track your orders. However, guest checkout is also available for your convenience.
  • If you create an account, you are solely responsible for maintaining the confidentiality of your account information, including your password. You agree to accept responsibility for all activities that occur under your account. Susfarm is not liable for any loss or damage arising from your failure to protect your account details.
  • You must provide accurate, complete, and current information when creating an account or placing an order.

Product Information & Orders

  • Product Accuracy: We strive to ensure that all descriptions, images, and pricing of Products on our Website are accurate. However, minor variations in product appearance may occur due to lighting conditions during photography or differences in display settings on various devices. While pricing errors are rare, we reserve the right to correct any such errors upon discovery.
  • Order Acceptance: Your order is considered officially accepted by Susfarm only after your payment has been successfully processed. You will receive an order confirmation via email once your order is accepted.
  • Product Availability: All Products are subject to availability. In the rare event that a Product you ordered becomes unavailable after your order is placed and accepted, we will notify you promptly via WhatsApp and will offer a replacement for the unavailable item. We do not offer refunds for unavailable items once an order is processed, only replacements.

Pricing & Payment

  • Currency: All prices displayed on the Website and all transactions are processed in Malaysian Ringgit (RM).
  • Pricing Changes: Susfarm reserves the right to change product prices at any time without prior notice. Any price changes will be updated on the Website. The price applicable to your order will be the price displayed at the time your order is placed.
  • Payment Gateway: All online payments for your purchases are securely processed through our trusted payment gateway partner, HitPay. Your payment details are processed directly by HitPay, subject to their terms and conditions and privacy policy. Susfarm does not store your credit card or sensitive financial information.

Delivery & Pickup

  • Delivery Area: We currently deliver exclusively within the Johor Bahru District, as specified on our Delivery Information page.
  • Delivery Schedule: All deliveries are made on Tuesdays, between 9:00am and 7:00pm.
  • Delivery Fees: Applicable delivery fees are RM10 per delivery for individual fresh greens & salad packs, and free delivery for all subscription plans. These fees are displayed before checkout.
  • Risk of Loss for Deliveries: For all deliveries, the risk of loss or damage to the Products transfers to you upon successful drop-off at your designated safe spot, as evidenced by a photo taken by our delivery personnel. While we do our best to ensure safe delivery, Susfarm is not responsible for any damage or spoilage that occurs after the delivery has been completed and the photo notification sent, especially if the produce is not retrieved promptly.
  • Risk of Loss for Pickups: For self-pickup orders, the risk of loss or damage to the Products transfers to you upon successful collection of your order at Susfarm.

Subscriptions

  • Subscription Duration: Our subscription plans are available for fixed durations (e.g., 1-month, 2-month, 3-month).
  • No Auto-Renewal: Please note that our subscription plans do not auto-renew. At the end of your chosen subscription duration, your subscription will expire. You will need to manually re-subscribe if you wish to continue receiving deliveries.
  • No Cancellation: Due to the nature of our fresh, perishable Products and pre-arranged harvesting schedules, all online purchases, including subscription plans, are final and cannot be cancelled once the order is placed and processed. Please ensure your selection is correct before confirming your purchase.

Quality Guarantee & Replacements

  • No Returns or Refunds: Due to the perishable nature of our fresh produce, we do not accept returns or offer refunds for purchases.
  • Replacement Policy: If you receive a Product that is damaged, of unsatisfactory quality, or incorrect, we will replace it with a new produce item.
  • Reporting Issues: You must report any such issues to our Customer Support within 1 hour of receiving your delivery. You are required to provide clear video evidence of the concern for our assessment.
  • No Physical Return: You are not required to send back the affected Product(s). Upon verification of the issue, we will arrange for a replacement delivery.

Intellectual Property

  • All content on the Website, including but not limited to text, graphics, logos, images, product names (e.g., Levfy, Mighty Kale Salad Pack), and company names (Susfarm), are the intellectual property of Susfarm Sdn Bhd or its content suppliers and are protected by Malaysian and international copyright, trademark, and other intellectual property laws.
  • You may not use, reproduce, modify, distribute, or display any content from our Website without our express written permission.

User Conduct

  • You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Website. Prohibited conduct includes, but is not limited to:
    • Using the Website for any illegal or unauthorized purpose.
    • Attempting to gain unauthorized access to any portion or feature of the Website or any other systems or networks connected to the Website.
    • Interfering with or disrupting the integrity or performance of the Website.
    • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

Limitation of Liability

  • To the fullest extent permitted by Malaysian law, Susfarm Sdn Bhd, its directors, employees, agents, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Website; (b) any conduct or content of any third party on the Website; (c) any content obtained from the Website; and (d) unauthorized access, use, or alteration of your transmissions or content.
  • In no event shall Susfarm’s aggregate liability for all claims relating to the Products or services exceed the amount you paid to Susfarm for the specific Products or services in question.

Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Malaysia.
  • Dispute Resolution: In the event of any dispute or claim arising out of or in connection with these Terms or your use of the Website:
    1. Informal Negotiation: Both parties agree to first attempt to resolve the dispute informally by contacting our Customer Support team via WhatsApp at +6019-982 7955 or email at ask@levfy.com.
    2. Mediation/Arbitration: If the dispute cannot be resolved through informal negotiation within a reasonable period (e.g., 30 days), both parties agree to engage in mediation or arbitration in Malaysia as a further attempt to resolve the dispute, if mutually agreed upon.
    3. Malaysian Courts: If mediation or arbitration fails to resolve the dispute, or if the parties do not agree to mediation/arbitration, either party may pursue remedies available under the laws of Malaysia in the appropriate Malaysian courts.

Amendments to Terms

  • Susfarm reserves the right to update, change, or replace any part of these Terms at our sole discretion. Any changes will be effective immediately upon posting to this page.
  • The “Last Updated” date at the bottom of this page will indicate when the Terms were last revised. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms. We will not notify users via email for changes to these Terms.
